Don’t Be Tempted To Hide Your Relationship Status  For Additional PR Points!

With the changes to the points test for general skilled migration from 16th November 2019 single applicants and applicants with a skilled partner who has competent English will receive an additional 10  PR points. To be eligible for partner points, applicants must satisfy skills assessment and/or English language requirements at the time of invitation.

The relationship status of an applicant is the date of the points test assessment by the decision-maker. The Department has made it clear that if the applicant’s relationship status or the residence status of their partner changes after the date of invitation or the date of application, the award of partner points may also change. This is to ensure applicants who are married or in a de facto relationship are not able to be awarded points on the basis of claiming to be without a spouse or de facto partner.

We have had many applicants tell us that they are considering a brief separation from their partner who may not be able to satisfy the skills assessment or English language criteria and add their partner once they receive an invitation to apply for the visa in the hope of gaining an additional 10 points.

It is important to note that any inconsistent or inaccurate information regarding the marital/de facto relationship status of the applicant will be looked at very carefully by the Department.  If an applicant’s relationship status has changed and they are no longer in a relationship they must substantiate this by providing documentary evidence.

For applicants who are tempted to hide your relationship from the Department be mindful that the Department can cancel your visa even after it is granted as ss 109  the Migration Act allows the Minister to cancel a visa if incorrect information or bogus documents were provided.
