Who can apply for the 482 Visa?

Frequently Asked Questions

The Subclass 482 Visa application process involves three main steps: sponsorship, nomination, and visa application.

Sponsorship

  • The employer must apply and be approved as a standard business sponsor or have a labour agreement in place.
  • The business must be actively and lawfully operating, and if located in Australia, must demonstrate a commitment to employing local labor and non-discriminatory recruitment practices.
  • Once approved, a standard business sponsorship is generally valid for five years. Sponsors may apply for accredited status for priority processing.

Nomination

  • The nomination must specify the occupation, terms, and conditions of the role offered to the overseas worker.
  • Depending on the chosen stream, the sponsor must ensure:
    • Core Skills Stream: The occupation is on the relevant Core Skills Occupation List and meets the Temporary Skilled Migration Income Threshold (TSMIT) of currently AUD 73,150 per annum (as of July 1, 2024).
    • Specialist Skills Stream: The occupation is listed under ANZSCO Major Groups 1, 2, 4, 5, or 6, with a nominated salary of at least AUD 135,000 per annum.
    • Labour Agreement Stream: The occupation must be specified within a valid Labour Agreement.
  • The position must be genuine, full-time, and essential to business operations.
  • Market salary rates must be paid to ensure overseas workers receive pay comparable to an Australian worker in the same role.
  • If the occupation is not exempt, labour market testing must be conducted to show no suitable local workers are available.
  • Sponsors must pay the Skilling Australians Fund (SAF) levy.

Visa Application

    • The applicant must provide evidence of work experience, qualifications, English proficiency, health and character.
    • The applicant must have a relevant skills assessment if required and meet any required registration or licensing standards for the occupation.
    • The visa application must be lodged with the Department of Home Affairs, accompanied by the required fees and documentation.
